This promotion is accessible to lawful inhabitants of the 50 United States, which includes the District of Columbia. Entrants must have reached the age of majority in their respective state of residence at the point of entry. BRCarClub PROMOTION PERIOD: Each offer will commence and conclude at the times specified on the promotional page displayed on our website.

BRCarClub ELIGIBILITY: The Sweepstakes is accessible solely to legal residents of any of the fifty (50) United States or the District of Columbia. However, residents of Puerto Rico, Guam, American Samoa, United States Territories, Possessions and Protectorates, foreign-based United States military installations, and locations where the sweepstakes are restricted or prohibited by law are excluded from participation. Participants must be aged 18 or older (referred to as the “Participant”). Potential prize winners chosen as entrants must possess a unique, personal, and valid social security number. This enables the Sponsor (defined in each draw) to report the appropriate tax liability linked to prize acceptance. The determination of valid social security numbers aligns with the criteria set by the Internal Revenue Service.

Sponsors, employees of Sponsors, and the various partners, parent companies, divisions, subsidiaries, affiliates, officers, advertising, promotion, and public relations agencies associated with Sponsors, along with their respective directors, officers, employees, agents, independent contractors, representatives, and agencies (collectively referred to as the “Sweepstakes Entities”), are ineligible to participate in the Sweepstakes or claim a Prize (as defined below). Furthermore, immediate family members of these employees and individuals residing in the same household as these employees (regardless of kinship) are also ineligible to secure victory. For the purpose of this Draw, “close family members” encompass spouses, domestic partners, mothers, fathers, grandmothers, grandfathers, and children.

Upon entering the Sweepstakes, Entrants commit to abide by these Official Rules and uphold the decisions made by the Sponsors/Organizers. These determinations are ultimate, binding in all aspects, and cannot be contested or appealed. 

 

HOW TO ENTER:

During the specified Promotion Period, there are three methods for participation:

OPTION 1 – Online Entry:

Within the Promotion Period, navigate to www.BRCarClub.com and make purchases from our virtual store. Participants need to provide all necessary information and a valid payment method during the purchase.

RECEIVE ONE (1) LUCKY NUMBER FOR EVERY $50.00 SPENT (excluding tax and shipping).

The number of Lucky Numbers granted is determined by the final purchase price, excluding taxes, shipping/handling, and any applicable discounts.

It’s important to note that Lucky Numbers will only be accumulated based on purchase subtotals.

Lucky Numbers will not be issued for shipping or handling fees. Returns, credits, or credit card chargebacks for store orders will reduce the total count of Online Store Lucky Numbers received. It’s important to highlight that if the Sponsor/Organizer issues a refund, or if an Entrant initiates a credit card dispute or chargeback, the corresponding Lucky Numbers linked to the refund, dispute, or chargeback will be revoked. Any credit card disputes or chargebacks filed after the Promotion Period concludes will be considered sweepstakes fraud and dealt with according to the law.

OPTION 2 – Entry via Membership:

During the Promotion Period, visit the website and register for the Brazilian Car Club Affiliate Program.

Adhere to the registration instructions to become either a Basic Member or an Ultimate Member.

Basic Membership – Involves a monthly subscription fee of $50.00

Participants receive one (1) Lucky Draw Number each month (or part of a month) they remain Basic Members in the Membership Program.

Ultimate Membership – Requires a monthly subscription fee of $150.00

Participants are entitled to receive three (3) Lucky Draw Numbers each month (or part of a month) they maintain Ultimate Membership status in the Membership Program.

*Enrollment is subject to maintaining Membership Program status. Cancelling membership during the Promotion Period leads to forfeiting Membership Program benefits. In cases where a Participant upgrades or downgrades their membership during the month, they will receive entries corresponding to the membership type in good standing starting from the 1st of the month. If the Sponsor issues a refund or the Participant initiates a credit card chargeback, the associated number of entries linked to the membership will be retracted.

OPTION 3 – Free Entry via Mail:

To obtain one Lucky Number without making a purchase, legibly write your full name, address, city, state, zip code, daytime phone number, date of birth (mm/dd/yyyy), and email address on a standard 3” x 5” white card. On the opposite side of the card, complete the sentence: “I would be delighted to be part of the BR CarClub winners’ circle because…” The response must exceed 20 words. Mail the white card (3” x 5”), along with a self-addressed stamped envelope, in another envelope to: BrCarClub Raffle, mentioning the relevant raffle, to: 910 Jimmy Ann Dr, Unit # 103 – Daytona Beach – FL – 32117. Receipts will be sent for each mailing request. Requests for correspondence must be handwritten exactly as specified above. Both outer and inner envelopes must feature a return address in the upper left corner, matching the applicant’s handwritten address. These envelopes must reach the sponsor no later than 10 days prior to the main draw date. Vermont (“VT”) residents can omit return postage for postmarked envelopes within VT. Applications sent in commercial reply envelopes, utilizing labels, stickers, photocopied, hand-stamped, computer-generated, or mechanically/digitally reproduced, or those not complying with these Rules, will not be honored, acknowledged, or returned. Applicants are advised to handwritten their submissions in a readable manner. Excessive or mechanically produced entries will be disregarded. Mail-in entries with no verifiable and legible return home address will be considered void. All mailed entries MUST contain the required information to be considered valid entries. Shipments containing multiple entries in one package will be invalidated. Each attendee can use this entry method only once. Confirmations of receipt for Mail-in Entries won’t be provided. Photocopies, facsimiles, or reproductions of Mail-in Entries won’t be accepted. The Sponsor/Organizer is not responsible for late, lost, damaged, stolen, incomplete, illegible, overdue, or misdirected entries. Proof of shipment does not equate to proof of delivery. Limit of one entry per person, family, and/or household.

All information must be fully completed to qualify. The use of automated devices or computer programs to participate in the Sweepstakes is prohibited.

By entering via online or mail-in methods, you agree to receive advertisements via email and SMS from the Sponsor, as per its Privacy Policy available at https://brcarclub.com/politica-de-privaciadade/. You can opt out of these ads through email and SMS without impacting your chances of winning. All entries become the exclusive property of the Sponsor/Organizer and will not be acknowledged or returned, except as indicated here.

BRCarClub WINNER SELECTION PROCESS :

The Brazilian Car Club will carry out a random draw, through our Website, generating 10 (ten) finalists who will compete with each other, in a second manual draw, transmitted live through our social media. Members may be present to watch the drawing at one of our offices.

 

The winner will be announced on the same day of the manual draw and will be communicated via previously registered telephone and email.

In the event the Prize is lost, Sponsor may, at Sponsor’s sole discretion, choose another winner.

If a potential winner is found to be ineligible or fails to comply with these Official Rules or any additional supplemental rules, that individual’s claim to a prize will be forfeited and an alternate qualified and eligible Entrant may be selected, at Sponsor’s sole discretion.

All legitimately claimed prizes will be awarded.

 

MAIN PRIZE : The “Grand Prize Winner” will receive the Main Prize in question. It can be: Car, Motorbike, Travel, Cash or a combination of these. 

Color, Options and Accessories of the vehicles will be determined at the sole discretion of the Sponsor/Organizer, as well as in the case of award trips, the destination will also be at the discretion and discretion of the Sponsor/Organizer.

Sponsor will provide one (1) standard low-cost airline ticket from a major commercial airport in the United States, which is the closest to the Winner’s main residence to one of Brazilian Car’s headquarters, so that the Winner of the drawing can receive your prize from the Sponsor/Organizer. 

Sponsor is not responsible for air transportation if the Winner resides less than 300 miles from the Venue. The Grand Prize Winner will also receive one (1) night’s accommodation in a hotel, within 30 miles of one of the Brazilian Car Club headquarters, determined by the Sponsor (room and taxes only).

Ground transportation to/from the airport to the hotel and to/from the hotel to the Grand Prize delivery location will be arranged by Sponsor. The Accommodation will have an approximate retail value of $200.00.

The approximate total retail value (“ARV”) for the Grand Prize will be disclosed on each draw’s disclosure page. 

Sponsor will determine air, flight and hotel accommodations within 30 miles of one of our headquarters in its sole discretion. If judgment of Sponsor’s air travel is not required due to the Grand Prize Winner’s proximity to the destination, ground transportation will be substituted for round trip travel at Sponsor’s sole and absolute discretion. The difference in value will not be awarded to the Grand Prize Winner. No refunds or compensation will be given in the event of cancellation or delay of any flight. Travel and accommodations are subject to availability. Grand Prize winners must have a credit card in their name to check into the hotel. Travel is subject to the terms and conditions set forth in these Sweepstakes and those set out by the Sponsor’s airline in detail in the passenger ticket contract. The Grand Prize winner will not receive a difference between real value and ARV. The prize is non-transferable and no substitutions will be made except as provided herein in Sponsor’s sole discretion. Sponsor reserves the right to substitute the Grand Prize (or a component thereof) for an equal or greater value if the designated prize becomes unavailable for any reason. All trips must be completed within 15 days of drawing result and must be booked with Sponsor or Administrator a minimum of seven (7) days in advance (unless approved by Sponsor), and is subject to Sponsor’s availability and approval. If a Grand Prize Winner fails to meet the Grand Prize requirements over a period of time, the Grand Prize Winner forfeits the Grand Prize in its entirety and an alternate winner may be selected. All travel dates will be determined by Sponsor, and once booked cannot be changed except by Sponsor. Some restrictions may apply. Meals not described above, incidentals, tips, phone calls or any other personal expenses incurred while traveling are the responsibility of the Grand Prize Winner. All other expenses not specifically identified as included in the Grand Prize are the sole responsibility of the Grand Prize Winner. Winner is responsible for obtaining travel insurance (and all other forms of insurance) at its option and hereby acknowledges that Sponsor does not and will not obtain or provide travel insurance or any other form of insurance. The Prize Winner is solely responsible for obtaining any identification documents required for domestic travel.

The winner of the draw is solely responsible for arranging for the transport of his prize, in case the prize is one of the Vehicle, from one of our headquarters to the final destination chosen, as well as providing a valid US driver’s license* * and provide proof of existing Motor Insurance Coverage (Comprehensive or Third Party). The Grand Prize Winner will be solely responsible for any applicableregistration, license, title and insurance, all taxes (federal, state, local and/or income) and any expenses not listed here in connection with acceptance and use of the Grand Prize. Sponsor does not make, nor is it in any way responsible for, any warranty, representation or warranty, express or implied, in fact or in law, relating to the Grand Prize, including but not limited to its quality, fitness for purpose, or condition mechanics; the only representation/warranty/guarantee that can be given in relation to the Grand Prix, if any, are those of the manufacturer and/or dealer. The Grand Prize Winner must comply with any and all applicable federal, state and local laws, rules and regulations, including but not limited to licensing and insurance requirements.

** If the randomly selected Winner is unable to provide a valid driver’s license, the randomly selected Winner must provide a state-issued passport or photo ID. If the randomly selected Winner needs assistance with travel or driving, the randomly selected Winner will be responsible for all expenses, including airfare, for the traveling companion. Please note that reasonable accommodations will be made for any randomly selected Winner to collect their prize, provided the above-mentioned requirements are met.

Prize Restrictions for the BRCarClub sweepstakes are as follows:

Prize Details: The Sponsor holds the authority to determine all the specific details of the prize, including its type, value, and components. No replacement for the Grand Prize or cash alternative will be provided, except at the sole discretion of the Sponsor or as outlined in the official rules.

Substitution of Prize: In the event that the Grand Prize becomes unavailable due to reasons beyond the Sponsor’s control, the Sponsor reserves the right to substitute the Grand Prize with a prize of equal or greater value. However, no substitute prize will be provided by the Sponsor without their prior written consent.

Prize Transfer: Prizes are non-transferable, meaning that they cannot be given or transferred to another person. The Grand Prize winner must be the individual who initially entered the sweepstakes and won the prize.

Determining Make and Models: The exact make and models of the Grand Prize (for example, if it’s a car) will be decided solely by the Sponsor. They have the authority to select the specific make and models that will be awarded as part of the prize.

Taxes and Expenses: Any taxes that are levied on the Grand Prize winner’s income as a result of winning the prize, as well as any other expenses that are not explicitly mentioned in the official rules as part of the Grand Prize, are the sole responsibility of the Grand Prize winner.

Publicity and Promotion: All award winners agree to allow the use of their name, likeness, biographical information, image, voice, and other persona-related information for publicity, promotion, and advertising purposes in any and all media, now or in the future, without requiring further compensation, notice, permission, or approval. However, residents of Tennessee will not be obligated to sign a publicity release as a condition of receiving their prize.

These prize restrictions are outlined in the official rules to ensure transparency and fairness in the sweepstakes. Prize Notification, claim process, and related terms for the BRCarClub sweepstakes are as follows:

Notification: The potential Grand Prize winner will be contacted by telephone and must respond within twenty-four (24) hours of the first attempted notification. They will be required to provide the requested information.

Non-Compliance or Ineligibility: If the potential Grand Prize Winner does not return the requested information by the specified date, is found to be ineligible, or fails to comply with the Official Rules, they will be disqualified.

Alternate Winner Selection: In the event of disqualification or non-compliance, an alternate potential Grand Prize winner will be randomly selected from the remaining eligible entries.

Undeliverable Notification: If the initial notification cannot be successfully delivered, the potential winner will be disqualified, and an alternate potential winner will be selected.

Required Paperwork: Except where prohibited, potential Grand Prize winners must sign and return an Affidavit of Title of Eligibility/Liability/Publicity Release and an IRS Form W-9 within the specified time to claim the Grand Prize.

Failure to Return Paperwork: If the potential Grand Prize winner fails to return the required paperwork by the indicated date, they will forfeit the Grand Prize. An alternate potential winner will be randomly selected from all eligible non-winning entries.

Tax Liability: The Grand Prize may have tax implications, and the Grand Prize Winner is solely responsible for any applicable federal, state, and local taxes associated with receiving the Grand Prize. The Sponsor must report the Grand Prize amount to the Internal Revenue Service (IRS) using Form 1099.

Social Security Number: If the potential Prize winner does not have a valid social security number for the Sponsor to report tax liability, they will be disqualified, and an alternate potential Grand Prize winner will be randomly selected.

Grand Prize Possession: Prize winners must take possession of the Prize within fifty-five (55) days of completing the required paperwork or by the specified Grand Prize deadline. Failure to do so will result in forfeiture of the Grand Prize without compensation.

Disclaimers and limitations of liability for the BRCarClub sweepstakes are as follows:

Release and Indemnification: By entering the Sweepstakes, entrants agree to release, indemnify, and hold harmless the Sweepstakes Entities, including platforms like Twitter, Facebook, Instagram, TikTok, and Google, along with their respective directors, officers, employees, agents, successors, and assigns (the “Released Parties”). This release covers claims, liabilities, costs, losses, damages, fines, or injuries arising from various aspects, including participation in the Sweepstakes, acceptance or use of prizes, violation of rights, and errors or inaccuracies.

No Warranty or Guarantee: Participants acknowledge that the Released Parties are not responsible for any warranty, representation, or guarantee, whether express or implied, in fact or in law, regarding the Sweepstakes or the prizes. Technical Errors and Failures: Sweepstakes Entities are not responsible for human errors, damaged, garbled, late, incomplete, inaccurate, misdirected, stolen, or otherwise improperly submitted entries. Sweepstakes Compromises and Force Majeure: If the Sweepstakes is compromised, interrupted, unable to function, or impeded due to factors like computer viruses, technical failures, unauthorized intervention, fraud, a force majeure event, or any other cause, the Sponsor reserves the right to modify, cancel, suspend, or withdraw the Sweepstakes without prior notice. A force majeure event includes events beyond Sponsor’s control, such as acts of God, terrorism, war, epidemics, natural disasters, labor disputes, and regulatory orders.

Enforcement of Rules: The Sponsor’s failure to enforce any term of the Official Rules does not constitute a waiver of those provisions.

Entry Information: Entry information becomes the property of the Sponsor.

General Conditions of entry for the BRCarClub Sweepstakes are as follows:

No Purchase Necessary: Participants confirm that they were not required to purchase any product or service to enter or participate in the Sweepstakes.

Participant Conduct: The Sweepstakes Entities are not responsible for participants’ actions related to the Sweepstakes. Tampering and Cheating: Tampering or abuse of any aspect of the Sweepstakes, including attempts to cheat or circumvent the rules, may lead to immediate disqualification and other potential consequences, such as disqualification from present and future drawings.

Website and Platform Misuse: Attempts to damage websites or social media platforms, or to disrupt the legitimate functioning of the Sweepstakes, may be considered violations of criminal and civil laws. Unsportsmanlike Conduct: The Sponsor has the right to disqualify individuals found to be violating the Official Rules or engaging in unsportsmanlike, obscene, immoral, or disruptive behavior intended to annoy, abuse, or disrupt the Sweepstakes.

Waiver of Section 1542 Rights: Entrants acknowledge that they are waiving any rights they may have under Section 1542 of the California Civil Code and similar laws of other states. Section 1542 states that a general release does not cover claims that the releasing party does not know about or suspect to exist at the time of releasing. The intention of the releases in the Official Rules is to cover claims that may not be known or suspected at the time of the release.

BRCarClub LAW: The parties agree that the Sweepstakes and these Official Rules or any additional supplemental rules shall be governed by, construed and construed under the laws of the State of Florida, without giving effect to any choice of laws or conflict of laws rules (whether of the State of Florida or any other jurisdiction) that would cause the laws of any jurisdiction other than the State of Florida to apply.

BRCarClub DISPUTE RESOLUTION : Entrants, Sponsors, Sweepstakes Entities and The Released Parties (each a “Party” and collectively the “Parties”) fully agree and finally resolve all disputes only through binding arbitration; provided that Sponsor has the right to seek injunctive or equitable relief in the state and federal courts of Pinellas County, Florida and any other court having jurisdiction over the Parties. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award are final and binding, with limited exceptions, and judgment on the award may be entered in any court having jurisdiction. The parties agree that, except as set out above, any claim, action or proceeding arising out of or relating to this Sweepstakes will be resolved by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in Jacksonville, Florida. Federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceeding involving any other party’s claim or controversy, including any class actions; provided, however, that if for any reason any court or arbitrator finds such restriction to be unreasonable or unenforceable,

the Sponsor or the Sweepstakes Entities (all such claims and disputes are collectively referred to as “Claims”). This arbitration agreement, however, does not include the Sponsors’ claims relating to intellectual property rights.

No preclusive effect. No award or finding or stipulation of fact by the arbitrator shall have any preclusive or collateral effect in any other court or arbitration unless it involves exactly the same parties.

Salvatorius. If any part of this arbitration provision is found to be invalid, unenforceable or illegal, the balance of this arbitration provision will remain in effect and will be construed in accordance with its terms as if the invalid, unenforceable or illegal provision were not contained therein.

Notwithstanding the foregoing, Sponsor may seek equitable relief in any court of competent jurisdiction.

BRCarClub LIMITATION OF LIABILITY: BY ENTERING THE Sweepstakes, ENTER AGREES THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH THE Sweepstakes, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF COLLECTIVE ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL, OUT OF POCKET THIRD PARTY COSTS INCURRED (IF ANY) DO NOT EXCEED FIVE DOLLARS ($5.00), BUT IN NO EVENT WILL ATTORNEY FEES BE AWARDED OR RECOVERABLE ; (C) UNDER NO CIRCUMSTANCES MAY ANY ENTRANTOR OBTAIN ANY PRIZE, AND THE ENTRY WAIVES ALL SEARCH, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL, LOST PROFITS AND/OR ANY OTHER DAMAGES, IN ADDITION TO ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED FIVE DOLLARS ($5.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) PARTICIPANTS’ REMEDIES ARE LIMITED TO ONE CLAIM FOR PUNITIVE DAMAGES (IF ANY) AND PARTICIPANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK PREVIOUS OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OR EXCLUSIONS OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

BRCarClub MISCELLANEOUS: The invalidity or unenforceability of any provision of these Official Rules, any additional supplemental rules, or the Statement will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules, any additional supplemental rules, or the Statement is held to be invalid or unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained in this document. . Sponsor’s failure to enforce any term of these Official Rules, any additional supplemental rules, or any other guidelines, instructions, policies, or term will not constitute a waiver of that provision. Entrant agrees to waive any right to claim ambiguity in these Official Rules or any additional supplemental rules. Headings are solely for convenience of reference and will not be deemed to affect in any way the meaning or intent of the documents or any provision of this document. BRCarClub WINNERS LIST : Grand Prize Winner will be announced on Sponsor’s website and/or social media pages after Grand Prize verification and Prize claimed. The list of winners will be available after winner validation is completed upon request.
